OFFICIAL RULES BookBrowse's First Impressions Program ("First Impressions") is provided by BookBrowsers LLC, ("BookBrowse") via its website at BookBrowse.com. First Impressions gives BookBrowse's members the chance to read and comment on advanced copies of upcoming books. ELIGIBILITY & ENTRY First Impressions is open to BookBrowse members who are also resident in the USA. Entries become the property of BookBrowse.com and the relevant publisher. SELECTION AND NOTIFICATION OF RECIPIENTS Initially selection of Advanced Reading Copies ("ARCs") will be on a first come first served basis with each member receiving one book, but overtime we will weight selections so that those who have not previously received a book get first priority, followed by those who have previously received and posted a review in the requested time period. BookBrowse.com's decision is final. Recipients will be notified by e-mail. The ARC is for the recipient's own personal use and may not be sold. All federal, state and local taxes are the recipient's responsibility. ARCs are not available for purchase, but their estimated value is approximately $20. CONDITIONS By requesting a book as part of the First Impressions program, members agree to be bound by these Official Rules. In addition, recipients of ARCs who elect to submit reviews to BookBrowse hereby grant BookBrowse and the book's publisher non-exclusive permission to use the recipient's review of the ARC, his or her first name, and his or her city/town of residence, for purposes of advertising, promotion and publicity without additional compensation, except where prohibited by law. BookBrowse reserves the right to edit such reviews for clarity or to use only excerpts of from them; however, BookBrowse will not do so in a manner that alters the substance of the review. BookBrowse has no obligation to publish a review. The entrants release, discharge, and hold harmless BookBrowse and its clients, affiliates, subsidiaries, assigns, attorneys, representatives and agents, including advertising, promotion and fulfillment agencies, from any and all liability or damages arising from the administration of The First Impressions Program and the use or misuse of any ARC received, including, without limitation, the following: (i) late, lost, incomplete, delayed, misdirected or unintelligible entries, (ii) any printing, typographical, administrative or technological errors in any materials associated with First Impressions, and (iii) any damage to the entrant's computer and related equipment and software resulting from entrant's downloading of information regarding First Impressions or participation in First Impressions. BookBrowse may only use the personally identifiable information obtained from the entrants in accordance with its privacy policy. BookBrowse reserves the right, in its sole discretion, to modify, cancel or suspend First Impressions entirely or with respect to one or more ARCs should a virus, bug, computer problem or other causes beyond its control corrupt the administration, security or proper operation of First Impressions. BookBrowse may prohibit you from participating in First Impressions or winning an ARC if, in its sole discretion, it determines that you are attempting to undermine the legitimate operation of BookBrowse by (i) cheating, hacking or employing other unfair practices, (ii) abusing other entrants or the representatives of BookBrowse, or (iii) otherwise violating any of these Official Rules. ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE OPERATION OF BOOKBROWSE MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND, IN SUCH EVENT, BOOKBROWSE RESERVES THE RIGHT TO PURSUE ITS REMEDIES AND DAMAGES (INCLUDING COSTS AND ATTORNEY'S FEES) TO THE FULLEST EXTENT OF THE LAW. FURTHERMORE, IN THE EVENT OF ANY UNAUTHORIZED COPYING OF AN ARC, OR ANY PORTION THEREOF, BOOKBROWSE & THE PUBLISHER OF THE SPECIFIC ARC RESERVE THE RIGHT TO PURSUE ITS REMEDIES AND DAMAGES (INCLUDING COSTS AND ATTORNEY'S FEES) TO THE FULLEST EXTENT OF THE LAW. This Agreement will be governed by the laws of the State of California. Any dispute arising from the terms of this agreement or breach of this agreement will be governed by the laws of the State of California and you agree to personal jurisdiction by the state and federal courts sitting in San Francisco, California. The parties hereby expressly waive trial by jury in any action, proceeding or counterclaim brought by either of the parties against the other on any matters whatsoever arising out of or in any way connected with these Terms and Conditions and agree to submit to binding arbitration. At time of selection, books are sent to the address on file via either Media Mail or First Class mail through the U.S. Postal Service. It is the recipient's responsibility to make certain the address on file is correct and complete. Neither BookBrowse nor the book's publisher will track or replace an ARC that is delayed, damaged, or lost in the mail. THE ODDS OF RECEIVING AN ARC DEPEND ON THE NUMBER OF ENTRIES RECEIVED & OTHER FACTORS EXPLAINED ABOVE. For the names of the recipients of an ARC, e-mail your request to info@bookbrowse.com at least one month, but no more than six months, after the date specified on the ARC selection page. |
